Slip & fall accidents are covered under Ohio premises liability law
Homeowners and business owners have responsibility to maintain and keep their properties and common areas free from dangerous hazards that could cause harm to the general public. Areas commonly in disrepair include stairs, crumbling concrete, rotting deck boards, etc. We receive frequent calls regarding ignored spills on the floors in retail shopping areas.
Snow and Ice
An exception to the premises liability law is the natural accumulation of snow and ice. Property owners DO NOT have a duty to remove natural accumulation of snow and ice, however, property owners DO have liability for unnatural accumulation of snow and ice. An example of unnatural accumulation would be where perhaps a detached downspout/gutter causes water to flow into a sidwalk area and then freeze, causing a fall.
At Blue + Blue Law in Columbus we represent individuals in personal injury slip and fall cases where they have been seriously injured, missed work, and sometimes needed long term care following a slip or fall.
"As citizens, we have a certain responsibility to be aware of our surroundings. In some instances, there are hazards which are not obvious and cause serious injuries. These situations should be reviewed by a personal injury attorney." -Douglas J. Blue
If you or someone close to you has been injured in a fall you should:
- Report the accident quickly.
- Take pictures of the cause of the accident.
- Immediately get a medical examination. This is the best proof an injury exists.
- Record everything. Keep a journal of who you talk to, costs of medical care, time off work, etc.
- Call Blue + Blue to discuss your situation as soon as possible.
